A strata corporation may, on its own behalf, sue a person against whom the corporation has a claim, including an owner.[6] In addition, in certain cases, a strata corporation may sue as a representative of the owners. Before a strata corporation sues as a representative on behalf of the owners, the Strata Property Act requires the corporation to first obtain prior authorization from the eligible voters at a general meeting. The requirement for prior authorization is explained later in this chapter.
To Enforce Compliance
Under section 173 of the Strata Property Act, a strata corporation may apply to the Supreme Court of British Columbia for an order to compel an owner, tenant or other person to:
- perform a duty he or she is required to perform under the Act, the regulations, bylaws or rules, or to
- stop contravening the Act, regulations, bylaws or rules.
